Rules & Eligibility
What is the PSARA Act, 2005?
The Private Security Agencies (Regulation) Act, 2005 (PSARA) is the central law that regulates private security agencies in India. It requires agencies to obtain a license from the state Controlling Authority, sets eligibility conditions, prescribes requirements for security guards such as training and verification, and provides penalties for violations. The Private Security Agencies Central Model Rules, 2020 supplement it. The Act text is on indiacode.nic.in. Read important provisions of the PSARA Act.
What are the eligibility requirements under the PSARA Act?
Under the PSARA Act, the applicant should generally be an Indian resident with clean antecedents, and must not fall under the disqualifications in Section 6, such as conviction for offences relating to security agency business or involving moral turpitude, or dismissal from government service for misconduct. In MP, the applicant also needs an office in the state and must meet training requirements. See PSARA eligibility criteria in MP.
Can a manpower supply company apply for a PSARA license in MP?
Yes, a manpower supply company that wants to provide security guards can apply for a PSARA license in MP, through any eligible entity type. However, since 2022 the words "Labour Supplier" and "Facility" are not allowed in the agency name, so a name change or separate entity may be needed. It must also meet the training, office and documentation requirements. Read about PSARA licenses for manpower supply companies.
Is a PSARA license required for supplying security guards to private companies?
Yes. Supplying security guards to private companies, housing societies, shops, factories or any other client is private security agency business, and Section 4 of the PSARA Act requires a license for it. This applies even if the business also supplies other manpower. Operating without a license can attract penalties under Section 20. See whether PSARA is mandatory for security guard companies.
Can a security agency operate in multiple districts with an MP PSARA license?
Yes, but only in the districts covered by the license. An MP PSARA license can be granted for one district, up to five districts or the entire state, with government fees of ₹5,000, ₹10,000 and ₹25,000 respectively. If you plan to expand, choose the coverage carefully at the time of application. See district-wise PSARA fees in MP.
Can an MP PSARA license be used to operate in another state?
No. An MP PSARA license authorises operation only within Madhya Pradesh, in the districts it covers. To provide security services in another state, you generally need a separate license from that state's Controlling Authority. An existing other-state PSARA license can, however, be submitted as a supporting document with your MP application. Read how to apply for a security agency license in India.
Can a security agency provide armed security guards under a PSARA license?
A PSARA license covers the security agency business itself; it does not by itself authorise guards to carry weapons. Possession and carrying of firearms is governed by the Arms Act, 1959 and requires separate arms licensing from the competent authority, with its own conditions. Agencies planning armed services should take specific legal advice before deploying armed guards. See MP PSARA license rules for security agencies.
Is security guard training mandatory under PSARA?
Yes. Under Section 10 of the PSARA Act, a security guard must be trained as prescribed, besides being an Indian citizen aged 18 to 65 with verified character and antecedents. The agency must arrange this training, usually through an MoU with an MP PSARA registered training institute. See training requirements for security guards under PSARA.
What are the responsibilities of a licensed private security agency?
A licensed private security agency must employ only eligible guards (Indian citizens aged 18 to 65, verified and trained), maintain the training arrangement, operate from its licensed office within the licensed area, keep registers and records as required, comply with labour laws such as EPF and ESIC, intimate material changes to the Controlling Authority and renew the license on time. See our MP PSARA yearly compliance service.
What are the consequences of operating a security agency without a valid PSARA license?
Operating a security agency without a valid PSARA license violates Section 4 of the PSARA Act. Under Section 20, it can attract a fine of up to ₹25,000, imprisonment of up to one year, or both. In practice, it can also lead to loss of contracts, difficulty in tenders, and problems when later applying for a license. Read about penalties for operating without a PSARA license.
Fees, Validity & Business
What is the total cost of MP PSARA license registration, including consultancy charges?
The total cost of MP PSARA license registration has three parts: the government fee (₹5,000 for one district, ₹10,000 for up to five districts, ₹25,000 for the whole state), costs of supporting items such as training certificates, the training institute MoU, registrations, stamp paper and notary, and professional fees. Professional fees depend on entity type and what is already in place, so we quote them after reviewing your case. See government fees and consultancy charges.
Does the PSARA license fee depend on the number of districts selected?
Yes. In Madhya Pradesh, the PSARA license government fee depends on the area of operation: ₹5,000 for one district, ₹10,000 for up to five districts and ₹25,000 for the entire state. Choose coverage based on where you actually expect to deploy guards. Confirm the current fee on the portal before paying. See whether there is a separate fee for each district.
Is a separate PSARA license required for each state in India?
Yes, generally. PSARA licenses are issued by each state's Controlling Authority and are valid only within that state. An agency providing services in several states needs a license in each of them. When applying in MP, an existing license from another state can be submitted as a supporting document, and an other-state company also provides the ESIC sub-code of its MP office. See applying for a security agency license in India.
Can I change my security agency's name after obtaining a PSARA license?
A name change after obtaining a PSARA license is generally possible only with intimation to, and approval or amendment by, the Controlling Authority, supported by updated entity documents and registrations. The new name must be available on the PSARA portal and must not use restricted words such as Detective, Investigation, Surveillance, Intelligence, Interrogation, Facility or Labour Supplier. Check the current procedure before changing it. See our MP PSARA compliance service.
How can I update the address on my MP PSARA license?
To update the address on your MP PSARA license, first update your Shop Act, GST, EPF, ESIC and other registrations to the new address, then intimate the change to the Controlling Authority with the new rent agreement or ownership proof and office photographs, as per the current procedure. The new premises may be verified. Do this promptly, not just at renewal. See our MP PSARA yearly compliance service.
How can I change the proprietor, partner or director details on a PSARA license?
To change partner or director details, intimate the change to the Controlling Authority with the amended partnership deed, LLP or company records, and the KYC, ITRs, training certificates and affidavits of incoming persons, who may also be police-verified. A change of proprietor is different, because a proprietorship belongs to one person and may need a fresh license. Confirm the route before acting. See partner and director document requirements.
What should I do if my PSARA license certificate contains incorrect details?
If your PSARA license certificate contains incorrect details, compare it with your application and documents to confirm where the error arose. If it is the authority's error, apply in writing to the Controlling Authority for correction with supporting proof. If the error came from your application, a correction request with corrected documents is needed. Act promptly, since clients and tenders rely on these details. See correcting errors in an MP PSARA application.
Is GST registration mandatory for obtaining a PSARA license?
In Madhya Pradesh, a GST registration certificate is part of the standard document list for proprietorship, partnership, LLP, company and society applicants, so in practice you should obtain GST registration before filing. Security services are also commonly within the GST framework once you start billing. We handle GST registration for security agencies as an add-on service.
Is company incorporation mandatory before applying for a PSARA license?
No. Company incorporation is not mandatory. A PSARA license can be obtained through a proprietorship, partnership firm, LLP, OPC, private limited company or society. Choose the structure based on ownership, liability and growth plans; incorporation documents are needed only if you choose an LLP or company. We help with company, LLP and firm registration for security agencies.
Can a security agency obtain a PSARA license if it has no existing clients?
Yes. Existing clients or work orders are not part of the standard MP PSARA document lists, so a new agency without clients can apply. In fact, you should not deploy guards for clients before obtaining the license. What matters is eligibility, the MP office, the training MoU, owners' training certificates and complete registrations. Read the legal requirements to start a security guard company in MP.
