Quick answer: Security agency trademark registration protects your agency name and logo, the same mark printed on guard uniforms, ID cards, office banners and invoices. Security services generally fall in Class 45. You can file online with IP India, use the TM symbol once the application is filed, and use the ® symbol only after the mark is registered.
In the security business your brand is literally worn in public. The MP PSARA application itself asks for guard photographs wearing the full uniform with the company logo and ID card, a demo employee ID card and, for companies, logo embroidery on cloth. Once you have invested in that logo, a competitor using a similar name or emblem can confuse clients and damage your reputation. Trademark registration gives you the legal right to stop that.
Why trademark matters for a PSARA-licensed agency
- Your logo is part of the license file. Uniform photographs, ID cards and embroidered logo samples go into the MP PSARA application. See PSARA documents for private limited company.
- Look-alike agencies are common. Similar names and badges are frequent in the security sector, and clients may not notice the difference.
- Exclusive rights: a registered trademark gives exclusive rights to use the mark for the registered services and to take action against infringement.
- Business value: a registered brand helps with franchising, expansion to other states and the value of the business if you ever sell or bring in partners.
Trademark registration is not a PSARA requirement, and the PSARA name check is different. The PSARA portal checks whether another licensed agency uses the same name. A trademark protects your brand against similar names and logos across India. We recommend clearing both.
Which class to file in
| Class | Relevance to a security agency |
|---|---|
| Class 45 | Security services for the protection of property and individuals, such as guarding and bodyguard services. This is the core class for most agencies. |
| Class 35 | Can be considered if you also offer business services such as manpower management or facility-related administration. |
| Class 41 | Can be relevant if you run a training institute or security training courses under the same brand. |
| Class 9 | Only if you sell security equipment, CCTV or electronic devices under your own brand. |
Choosing the class depends on what you actually offer under the brand. Filing in unnecessary classes adds cost; leaving out a class you use leaves a gap.
Before you file: a quick checklist
- Search the register on IP India's public search for identical or similar marks in your class.
- Check the PSARA portal so your name is also available for licensing and avoids the restricted words, as explained on our company registration page.
- Avoid descriptive marks. A plain name like "Best Security Services" is hard to register. A distinctive word or a distinctive logo is stronger.
- Finalise the logo in the form you will use on uniforms and ID cards, so the registered mark matches real use.
- Note your date of first use, backed by invoices, work orders or photographs if you are already using the mark.
Documents required
- Applicant's name, address and nationality; for a firm, LLP or company, its entity details
- The word mark and/or logo in a clear image file
- Description of services and class
- Date of first use, or "proposed to be used"
- Evidence of use, if claiming prior use
- Udyam certificate, if you want the lower official fee available to MSMEs (see Udyam / MSME registration)
- Power of attorney (Form TM-48) when filed through an agent
Trademark registration process
- Filing: the application is filed online on the IP India portal, accessible from ipindia.gov.in, and an application number is issued immediately. You can start using the TM symbol.
- Examination: the Trade Marks Registry examines the mark and issues an examination report, which may raise objections for similarity or descriptiveness.
- Reply and hearing: objections are answered in writing, and a hearing may be scheduled if needed.
- Publication: once accepted, the mark is advertised in the Trade Marks Journal.
- Opposition period: third parties can oppose within four months of publication.
- Registration: if there is no opposition, or it is decided in your favour, the registration certificate is issued and you can use the ® symbol.
Timeline
Timelines at the Trade Marks Registry vary. In practice, a mark that faces no objection or opposition is often registered in around a year or more, while objections, hearings or oppositions can extend this considerably. The protection, once granted, dates back to the filing date, which is why filing early matters. A registration is valid for ten years and can be renewed every ten years.
Do not use the ® symbol on uniforms, ID cards or letterheads until the mark is actually registered. Using it on a pending application is not permitted. Use TM in the meantime.
Common mistakes with security agency brands
- Copying the colours or badge design of a well-known agency, or using police-style emblems that may attract objections.
- Filing only the word mark when the logo is what clients and the public recognise, or the other way round.
- Changing the logo after filing, so the registered mark no longer matches what is printed on uniforms.
- Filing in the name of one partner personally when the business belongs to the firm or company.
- Missing the deadline to reply to an examination report, which can lead to the application being treated as abandoned.
How it fits into your PSARA filing
We usually finalise the agency name and logo before ordering uniforms and ID cards, because those items are photographed for the PSARA file. Filing the trademark at the same time means the brand on your uniform photograph is the same brand you are protecting. It does not delay the MP PSARA license registration; the two run in parallel.

Frequently Asked Questions
Is trademark registration compulsory for a PSARA license in MP?
No. It is not on the MP PSARA document list. However, your logo appears on uniform photographs, ID cards and embroidered samples in the application, and you will use it on every guard in the field. Registering it protects that investment and lets you act against agencies using a confusingly similar name or emblem.
Which trademark class covers security guard services?
Security services for the physical protection of property and individuals generally fall in Class 45. If you also run a training institute under the same brand, Class 41 may be relevant, and if you sell security equipment under your brand, Class 9. We review your actual services before recommending classes.
Can I use my brand while the trademark application is pending?
Yes. Once the application is filed you can use the brand with the TM symbol. Only after registration can you use the ® symbol. If someone else has an earlier application for a similar mark, using the brand can carry risk, so a search before filing and before ordering uniforms is worthwhile.
If my name is approved on the PSARA portal, is it protected as a trademark?
No. The PSARA name check only confirms that no other licensed agency uses the same name. It does not give you trademark rights or stop someone from using a similar name or logo. Trademark registration with IP India is a separate process that gives enforceable rights across India.
