Is a PSARA License Mandatory for Security Guard Companies in MP?

Is a PSARA License Mandatory for Security Guard Companies in MP?

Quick answer: Yes. A PSARA license is mandatory for security guard companies in Madhya Pradesh. Section 4 of the PSARA Act, 2005 bars anyone from carrying on or starting a private security agency business without a license from the Controlling Authority. Calling the business manpower supply or facility management does not remove the requirement if security guards are being provided to clients.

We are often asked this question by businesses that already supply housekeeping staff, drivers or general manpower and want to add guards, or by companies that want to know whether their existing arrangement needs a license. The short answer is that if you provide private security to others, the PSARA license is mandatory for security guard companies. The longer answer depends on what exactly you do, so this article walks through the law and the common scenarios.

What the law says

The Private Security Agencies (Regulation) Act, 2005 regulates private security agencies. Section 4 provides that no person shall carry on or commence the business of a private security agency, and no agency shall provide private security guards, without a license under the Act. The full text is on India Code. In Madhya Pradesh, the license is issued by the Controller of PSARA, Madhya Pradesh.

The Act focuses on the service provided, not on the label used. A company registered as a "services" or "manpower" company that supplies security guards to a factory is, in substance, providing private security.

Scenario guide

Your situationIs a PSARA license needed?Comment
You supply security guards to housing societies, factories, offices or eventsYesThis is the core activity the Act regulates
You provide facility management and include guards in the contractYes, for the security componentBundling does not exempt the guarding service
You are a manpower supplier adding guards to your servicesYesObtain the license before deploying any guard
You are licensed in another state and want to deploy in MPGenerally yes, an MP licenseThe MP checklist includes the other-state license and MP ESIC sub-code
Your company employs its own watchmen only for its own premisesUsually a different positionIn-house security for one's own premises is not normally "agency" business; take advice on your specific facts
You only sell CCTV or alarm equipment, with no guardsDepends on the services offeredPure equipment sale is different from providing security personnel; check the scope of what you offer

Grey area caution: Where your business sits at the boundary, do not assume an exemption. Get a written opinion based on your contracts. The cost of a wrong assumption includes prosecution risk and loss of clients.

Three questions to test your own business

If you are still unsure, answer these honestly:

  1. Are the people you supply expected to protect persons or property at the client's site? If yes, that is security work, whatever the job title on the invoice.
  2. Do they wear a uniform and carry an ID that presents them as guards? Clients and the public will treat them as security personnel.
  3. Are they employed and paid by you, but working under a client contract? That is the agency model the Act was written for.

Two or more "yes" answers almost always point to a licensing requirement.

Why clients increasingly insist on PSARA

Even apart from the law, the market has moved. Many corporate clients, PSUs, hospitals and government departments now ask for the PSARA license as a basic qualification in tenders and vendor onboarding. Housing societies and builders also check it more often than before. An agency without a license may find it cannot bid for the contracts it wants, regardless of its prices or experience.

Consequences of not having a license

  • Statutory penalty: under Section 20, a fine of up to ₹25,000, or imprisonment up to one year, or both.
  • Contract risk: clients may terminate or refuse to renew contracts with an unlicensed agency.
  • Tender disqualification: most institutional tenders ask for a valid PSARA license.
  • Problems at application stage: a history of unlicensed operation can complicate later applications.

Who can apply and what it costs

A proprietorship, partnership firm, LLP, OPC, private limited company or society can apply, provided the applicant is an Indian resident with clean antecedents and has a business place (office) in Madhya Pradesh. The government fee depends on the area of operation:

CoverageGovernment fee
One district₹5,000
Up to five districts₹10,000
Entire Madhya Pradesh₹25,000

Professional fees are separate and quoted after reviewing your case. More detail is on our MP PSARA license government fees page.

How to move from unlicensed to licensed

  1. Stop taking new guarding contracts until the license is granted.
  2. Check your agency name on the portal; change it if it duplicates another or uses a disallowed word.
  3. Put the basics in place: MP office, Gumasta, GST, EPF and ESIC.
  4. Get training certificates for owners and an MoU with an MP PSARA registered training institute.
  5. Prepare all affidavits, photos, ID card and uniform samples.
  6. Apply on psara.gov.in, pay the fee and track police verification and queries.

In practice, approval commonly takes about 60-90 days, mainly depending on police verification and query replies.

What about renewal?

A license is valid for five years unless cancelled. If it expires, you are back to operating without a valid license. Apply for renewal at least 45 days before expiry; we recommend starting 60-90 days ahead. See our MP PSARA license renewal service.

Frequently Asked Questions

I only supply two or three guards. Do I still need a PSARA license?

Yes. The Act does not exempt small operators. Section 4 prohibits carrying on private security agency business without a license, regardless of the number of guards supplied. Even a small agency should obtain the license before deploying guards to any client. If your situation is unusual, share the details with us and we will confirm the current position before you act.

Does a housing society need a PSARA license to hire its own watchman?

A society that directly employs a watchman for its own premises is generally not running a security agency business. The licensing requirement applies to agencies providing private security to others. However, if the society hires guards through an agency, that agency must hold a valid PSARA license.

Is the PSARA license from Delhi or Maharashtra valid in Madhya Pradesh?

A PSARA license is issued for a state and its area of operation. To provide guards in Madhya Pradesh you generally need an MP license from the Controller of PSARA, Madhya Pradesh. Your other-state license is submitted as a supporting document if available.

Can I use the word Facility in my company name if I get a PSARA license?

Since 2022, FACILITY is among the words not allowed in agency names in MP, along with DETECTIVE, INVESTIGATION, SURVEILLANCE, INTELLIGENCE, INTERROGATION and LABOUR SUPPLIER. A company with such a name would need to change it before applying. If your situation is unusual, share the details with us and we will confirm the current position before you act.
