Is PSARA License Registration Mandatory for Security Agencies in MP?
Quick answer: Yes. A PSARA license is mandatory in MP for anyone who carries on or provides private security agency business. Section 4 of the Private Security Agencies (Regulation) Act, 2005 prohibits operating without a licence, and Section 20 provides a fine up to ₹25,000, imprisonment up to one year, or both. The licence is issued by the Controller of PSARA, Madhya Pradesh.
We are regularly asked whether a PSARA license is mandatory in MP for small operators, new start-ups, firms that "only supply manpower" or agencies already licensed elsewhere. The short answer is that if you are in the business of providing security guards or security services to others in Madhya Pradesh, you need an MP licence. This article explains the legal basis, works through common "do I need it?" situations and lists what to do next.
What the law actually says
The Private Security Agencies (Regulation) Act, 2005 – usually called PSARA – regulates private security agencies across India. Two provisions matter most for this question:
- Section 4: no person shall carry on or commence the business of a private security agency, or provide private security services, without a licence under the Act.
- Section 20: anyone who contravenes this can be punished with a fine up to ₹25,000, or imprisonment up to one year, or both.
The licence is state-specific. Each state has a Controlling Authority; in Madhya Pradesh, licences are issued by the Controller of PSARA, MP through the official PSARA portal. You can read the Act on India Code, and the Private Security Agencies Central Model Rules, 2020 provide the central framework.
"Do I need a licence?" – common situations
| Situation | Licence needed in MP? | Why |
|---|---|---|
| New agency supplying guards to housing societies in Bhopal | Yes | Providing private security services to others |
| Agency licensed in Gujarat starting work in Indore | Yes, an MP licence | Licences are issued state-wise |
| Manpower firm adding "security staff" to its services | Yes, for the security part | The nature of the service, not the label, decides |
| Proprietor who is a retired Army officer | Yes | Background helps eligibility but does not replace the licence |
| Agency waiting for approval, client wants guards now | Cannot deploy yet | Business can start only after the licence is granted |
| Company directly employing its own watchmen for its own premises | Depends on facts | Take advice; the Act targets agencies providing security to others |
The last row is a genuine grey area that depends on how the arrangement is structured. If your case is not clearly covered, get it reviewed rather than assuming you are exempt.
Why the licence matters beyond the penalty
Clients ask for it
Banks, hospitals, industries, government departments and large housing societies usually ask for a valid PSARA licence during vendor registration or in tenders, along with GST, EPF and ESIC certificates.
It structures your guard workforce
Licensed agencies must deploy guards who meet Section 10 requirements: Indian citizens aged 18–65, with verified character and antecedents, trained as prescribed. That is why the application requires an MoU with a registered training institute.
It protects your business
Running without a licence exposes the owners to prosecution and can lead to contracts being cancelled once a client discovers the gap. A licensed agency can grow, bid and renew with confidence.
It keeps your future options open
A licence once obtained has to be renewed every five years, and a clean record of operating only after licensing makes renewals, expansions to more districts and applications in other states far smoother. Starting unlicensed and regularising later leaves a history that can raise questions at each of those points.
Who can apply
A proprietorship, partnership firm, LLP, OPC, private limited company or society can apply in MP. The applicant must be an Indian resident with clean antecedents and must have a business place (office) in Madhya Pradesh. Persons listed under Section 6 – for example those convicted of offences involving moral turpitude, or dismissed from government service for misconduct – are not eligible. See our guide on PSARA eligibility criteria in MP.
If you are already operating without a licence
Some small operators start informally and then realise the requirement. The right course is to stop providing security services until licensed and begin the application immediately. Practical steps:
- Pause deployments that count as private security services.
- Choose your entity and check the agency name on the portal, avoiding barred words like DETECTIVE and FACILITY.
- Set up an MP office and obtain Shop Act, GST, EPF and ESIC registrations.
- Complete owner training and sign an MoU with a registered training institute.
- File the application with all documents and pay the slab fee.
We do not advise continuing operations "in parallel" with the application; the law requires the licence before business begins.
What the licence costs and how long it takes
Government fees in MP are ₹5,000 for one district, ₹10,000 for up to five districts and ₹25,000 for the entire state. Approval has no fixed statutory deadline, but in practice it commonly takes about 60–90 days, mainly due to police verification and query replies. The licence is valid for five years and must be renewed with an application at least 45 days before expiry.
The penalty under Section 20 applies per contravention as decided by the court. The fee for a one-district licence is a fraction of the maximum fine – compliance is the cheaper path.

Frequently Asked Questions
Do individual security guards need a PSARA licence?
No. The licence is for the agency that carries on the business of providing private security. Individual guards do not take a licence themselves, but the agency must ensure each guard meets the Act's conditions, including Indian citizenship, age between 18 and 65, verified antecedents and the prescribed training.
Is an all-India PSARA licence available?
PSARA licences are issued state by state by each state's Controlling Authority. An agency that wants to work in several states applies in each of them. In Madhya Pradesh, the area of operation can be one district, up to five districts or the entire state.
Can I take advance orders before my licence is issued?
You may discuss future requirements with prospective clients, but you should not provide security services or deploy guards until the licence is granted. Be careful with contracts that commit you to a start date, because approval timelines depend on police verification and query replies.
Does a society or trust need a PSARA licence to run a security agency?
Yes, if it carries on the business of a private security agency. A society is one of the entity types that can apply in MP, and its document list includes the chairman's documents, the proprietorship-firm items, society PAN, by-laws and the list of members.
