How to Start a Security Guard Company in Madhya Pradesh: Legal Requirements
Quick answer: To start a security guard company in Madhya Pradesh, you must form an eligible entity, choose a PSARA-compliant name, set up an office in MP, obtain Gumasta, GST, EPF and ESIC registrations, sign an MoU with an MP PSARA registered training institute, complete owner training, and obtain a PSARA license before deploying a single guard.
Many people who want to start a security guard company in Madhya Pradesh begin by looking for clients. Legally, that is the last step. The Private Security Agencies (Regulation) Act, 2005 makes it an offence to carry on or provide private security agency business without a license (Section 4), and the penalty under Section 20 is a fine up to Rs 25,000, imprisonment up to one year, or both. Everything else must be in place first.
This guide sets out the legal requirements in the order in which they are best tackled, so that each step supports the next.
Step 1: Confirm personal eligibility
Before investing in an office or uniforms, check that the proprietor, every partner or every director is eligible. Under Section 6 of the PSARA Act, certain persons cannot obtain a license, for example those convicted of an offence relating to security agency business or involving moral turpitude, or those dismissed or removed from government service on grounds of misconduct. The applicant should be an Indian resident with clean antecedents. One ineligible partner can hold up the whole application, so resolve this at the start. Step 2: Choose the right legal entity
A security agency in MP can be a proprietorship, partnership firm, LLP, OPC, private limited company or society. The choice affects liability, documentation and how easily you can bring in partners later.
| Entity | Suits | Key extra documents for PSARA |
|---|---|---|
| Proprietorship | Single owner starting small | Owner's personal documents only |
| Partnership firm | Two or more owners, simple structure | Partnership deed, firm PAN |
| LLP | Partners wanting limited liability | Incorporation certificate, LLP agreement |
| OPC / Private limited | Agencies aiming for large corporate or government contracts | Incorporation certificate, MOA and AOA, company PAN |
| Society | Ex-servicemen or welfare bodies | Society PAN, by-laws, list of members |
We can form the entity for you through our company, LLP and firm registration service.
Step 3: Pick a name the portal will accept
This is where many new founders lose time. Before registering the entity, check the name on the PSARA portal; if the same name already exists, choose another. Since 2022, the following words are not allowed in a security agency's name in MP: DETECTIVE, INVESTIGATION, SURVEILLANCE, INTELLIGENCE, INTERROGATION, FACILITY and LABOUR SUPPLIER. Register your company or firm only after the name passes this check, because changing an incorporated company's name later is slow.
Step 4: Set up a proper office in Madhya Pradesh
The PSARA application requires a place of business in MP. You will need a rent agreement, NOC or ownership document, and inner and outer photographs of the office with a banner showing the agency name. The office may be physically verified by police, so a genuine, functioning office is essential. A virtual address will not serve this purpose.
Step 5: Obtain business and labour registrations
A security agency is a labour-intensive business, and PSARA documentation reflects that. Before applying, obtain:
- Shop and Establishment (Gumasta) registration for the MP office
- GST registration, since security services are taxable and clients expect GST invoices; see GST registration for security agencies
- EPF registration with the EPFO
- ESIC registration, and for other-state companies the ESIC sub-code of the MP office
- A labour license, if available, for partnership firms, LLPs and companies
Optional but useful: Udyam (MSME) registration, trademark protection for your brand and ISO certification, which some tenders ask for.
Step 6: Training and MoU
The proprietor, all partners or all directors need a training certificate from an MP PSARA registered training institute. The agency also needs an MoU with such an institute so its guards receive training as prescribed. These two items are among the most commonly missing documents in first-time applications. Our MoU with training institute service arranges both.
Step 7: Prepare uniform, ID card and affidavits
The application expects evidence that the agency is ready to operate: a demo employee ID card, four-side photographs of a guard in full uniform with company logo and ID card, and for firms and companies a cloth sample of the uniform. Affidavits such as Form 3 and Form 7 for proprietors, or affidavits of all directors for companies, must be drafted correctly. We prepare all of these formats as per MP PSARA guidelines.
Step 8: Apply for the PSARA license
- Create a profile on psara.gov.in
- Fill the form and upload documents
- Pay the government fee: Rs 5,000 for one district, Rs 10,000 for up to five districts, or Rs 25,000 for all of MP
- The Controller of PSARA, Madhya Pradesh issues a letter for police verification of owners and office
- Reply to any portal query and re-submit
- On successful verification, the Controller issues the license if everything is in order
In practice, this commonly takes around 60 to 90 days. The complete document list is on documents required for MP PSARA registration.
Step 9: Legal requirements after you start
Once licensed, compliance continues:
- Every guard must be an Indian citizen aged 18 to 65, with character and antecedents verified and training as prescribed (Section 10)
- Maintain registers and records of guards, supervisors and deployments
- File EPF, ESIC and GST returns on time
- Renew the license, which is valid for five years, with the application at least 45 days before expiry
Do not sign client contracts or deploy guards on the strength of an application alone. Wait for the license.
If you are planning a new agency, our MP PSARA license registration service handles every step above, from entity formation to the final license.
Frequently Asked Questions
Can I start providing guards while my PSARA application is pending?
No. Section 4 of the PSARA Act prohibits carrying on or providing private security agency business without a license. An application acknowledgement is not a license. Deploying guards before the license is issued can attract a fine up to Rs 25,000, imprisonment up to one year, or both.
Which entity is best for a new security guard company in MP?
It depends on your plans. A proprietorship is simplest for a single owner. A private limited company or LLP suits founders targeting large corporate or government clients or planning to add partners. Each requires different PSARA documents, so decide before you start collecting paperwork.
Do I need EPF and ESIC before applying for the PSARA license?
Yes. EPF and ESIC registration certificates are part of the document list for proprietorships, partnerships, LLPs, companies and societies applying in Madhya Pradesh. Obtain them along with Gumasta and GST before you file the application. Pending registrations are a common cause of rejection or queries later.
Can I use the word Facility in my security company's name?
Since 2022, MP does not allow words such as Facility, Labour Supplier, Detective, Investigation, Surveillance, Intelligence and Interrogation in security agency names. Choose a name without these words and check it on the PSARA portal before registering your entity. This saves a later name change.
