Can a Security Agency Operate Without a Valid PSARA License?

Can a Security Agency Operate Without a Valid PSARA License?

Quick answer: No. Section 4 of the PSARA Act, 2005 says no person can carry on or provide private security agency business without a license. Operating a security agency without a valid PSARA license, including after expiry, can attract a fine up to ₹25,000, imprisonment up to one year, or both under Section 20, besides losing clients and contracts.

The question of running a security agency without a valid PSARA license usually comes up in three situations: a new agency that has won a contract before its license is issued, an existing agency whose license has expired, and a business that supplies manpower and is unsure whether it is a "security agency" at all. The legal answer is the same in all three cases, but the practical steps differ. This post walks through each scenario.

What the law actually says

The Private Security Agencies (Regulation) Act, 2005 is short and direct on this point. You can read the full text on India Code by searching for PSARA.

  • Section 4: no person shall engage or provide private security guards, or carry on the business of a private security agency, without a license.
  • Section 8: a license is valid for five years unless cancelled, and renewal should be applied for at least 45 days before expiry.
  • Section 20: contravention of Section 4 is punishable with a fine up to ₹25,000, or imprisonment up to one year, or both.

A valid license means one that has been issued, is within its validity period, has not been cancelled or suspended, and covers the area where you operate. In Madhya Pradesh the license is issued by the Controller of PSARA, Madhya Pradesh, for one district, up to five districts, or the whole state depending on the fee paid.

Scenario 1: New agency waiting for its license

Applying is not the same as being licensed. Even if your application has been submitted and police verification is under way, you are not yet authorised to deploy guards in your own name. Some owners try to "start small" with one or two sites. The risk is that any complaint, inspection or dispute at that site exposes you to prosecution and can also be held against you while the Controller is still deciding your application.

A safer approach is to finish your groundwork during the waiting period: register EPF and ESIC, arrange the MoU and guard training, design uniforms and ID cards, and prepare client proposals. Our post on reducing delays in MP PSARA registration explains how to shorten the waiting period itself.

Scenario 2: License expired or about to expire

An expired license is legally the same as no license. If your five-year term has ended and the renewal has not been granted, you are exposed for every day of continued operation. Clients, especially banks, PSUs and corporates, often audit vendor licences and may stop payments or terminate contracts when they find an expired certificate.

We cover this in more depth in what happens if your MP PSARA license expires, and our MP PSARA license renewal service handles the filing end to end.

Scenario 3: Manpower supplier unsure if PSARA applies

Many housekeeping or labour contractors also provide "watchmen" or "gatemen". If the people you supply are engaged to protect persons or property, that work is private security under the Act, whatever the job title on the invoice. Calling it "facility" or "labour supply" does not change the nature of the service. In fact, since 2022 words such as FACILITY and LABOUR SUPPLIER are not allowed in an MP PSARA agency name, which signals how clearly the two businesses are separated.

Practical consequences beyond the penalty

  • Loss of tenders: government and corporate tenders usually ask for a valid PSARA license as a basic eligibility document.
  • Payment disputes: clients may withhold payment if they discover the vendor was not licensed.
  • Future applications: a record of unlicensed operation can complicate later licensing or renewal decisions.
  • Liability exposure: in case of theft or injury at a site, an unlicensed agency is in a weak position legally and with insurers.

Important: Subcontracting your guards under another licensed agency's name, without a proper and transparent arrangement, does not make your own operation licensed. Take advice before relying on such arrangements.

How to regularise the right way

  1. Stop accepting new deployments in your own name until you hold a valid license.
  2. Check your proposed agency name on the PSARA portal and avoid the restricted words.
  3. Arrange office, Gumasta, GST, EPF, ESIC, the training MoU and promoter training certificates.
  4. File the new or renewal application with complete documents and pay the correct district-based fee.
  5. Prepare the office and promoters for police verification and respond quickly to any portal query.

What clients should check

If you are a hospital, school, housing society or factory hiring a security vendor, ask for a copy of the PSARA license, check the validity dates and the districts it covers, and confirm that the agency name on the license matches the name on the contract and invoices. Asking for this once a year protects you as much as it protects the agency, because an unlicensed vendor leaves gaps in liability and statutory records.

If you are currently operating without a valid license, the most useful step is a quick review of your situation. Call us and we will tell you plainly what needs to be filed and in what order.

Frequently Asked Questions

Can I supply guards once my PSARA application is submitted?

No. Submission only starts the process; the right to carry on security agency business comes from the license itself. Until the Controller of PSARA, Madhya Pradesh issues the license, deploying guards in your own name can be treated as a contravention of Section 4. Use the waiting period to complete EPF, ESIC, training and uniforms.

Is there any grace period after a PSARA license expires?

The Act does not give a general grace period for operating after expiry. It asks you to apply for renewal at least 45 days before the license ends. Once the validity period is over and renewal has not been granted, the agency should treat itself as unlicensed and seek advice on regularising the position quickly.

Does my MP license allow me to work in another state?

A PSARA license is issued by the Controlling Authority of a state and covers the area granted in that state. To operate in another state, you generally need a license from that state's Controlling Authority as well. Your MP license is still useful as supporting documentation when applying elsewhere.

Who can be punished if an agency works without a license?

Section 20 provides penalties for any person who contravenes Section 4. In practice, the proprietor, partners or directors responsible for the business are the ones exposed. Clients knowingly engaging unlicensed agencies may also face questions, which is why many of them now verify licenses before awarding contracts.
