Who Can Apply for an MP PSARA License in Madhya Pradesh?
Quick answer: A proprietorship, partnership firm, LLP, one person company, private limited company or society can apply for an MP PSARA license, provided the owners are Indian residents with clean antecedents, have completed PSARA training and the agency has an office in Madhya Pradesh. Persons disqualified under Section 6, such as those convicted of offences involving moral turpitude, cannot apply.
The question of who can apply for an MP PSARA license has two layers. The first is the type of entity. The second is the individuals behind it, because the police verify the people, not just the business. This article explains both and walks through the cases we are asked about most.
Layer 1: Entity types that can apply
| Entity | Whose eligibility is examined | Constitution documents |
|---|---|---|
| Proprietorship | The proprietor | None beyond owner and firm documents |
| Partnership firm | All partners | Partnership deed, firm PAN |
| LLP | All partners | LLP agreement, incorporation certificate, LLP PAN |
| One person company | The director(s) | Incorporation certificate, MOA and AOA, company PAN |
| Private limited company | All directors | Incorporation certificate, MOA and AOA, company PAN |
| Society | The chairman | Society PAN, by-laws, list of members |
An OPC is a company, so its documentation broadly follows the private limited pattern. For the full lists, see the pages on PSARA documents for an LLP and PSARA documents for a society.
Layer 2: The people behind the agency
Regardless of entity, the individuals who own or control the agency must meet certain basics:
- Indian resident applicant. The applicant and owners should be Indian residents.
- Clean antecedents. Police verification covers the proprietor, or every partner or director.
- PSARA training. A training certificate from an MP PSARA registered institute is required for the proprietor, partners or directors, or the society chairman.
- Income tax history. ITRs of the last three years form part of the personal documents.
Who cannot apply
Section 6 of the PSARA Act lists persons who are not eligible for a license. Keeping it general, this includes a person who has been convicted of an offence relating to the security agency business or of an offence involving moral turpitude, and a person dismissed or removed from government service on grounds of misconduct, among other grounds set out in the Act. If any partner or director falls within Section 6, the application can be affected as a whole. Read the exact wording on India Code and take advice if in doubt.
Important: One ineligible partner or director can hold up an otherwise complete application. Review every person's background before you add them to the firm or board.
Special cases
Ex-servicemen and retired government employees
Retired Army, government or PSU personnel can apply and often do. Add the government job retirement document to personal papers. Note that the Section 6 exclusion concerns dismissal or removal on grounds of misconduct, not normal retirement.
Agencies licensed in another state
You can apply in MP, but you need an MP office, the ESIC sub-code for that office and your other-state license copy. The other-state license does not by itself permit work in Madhya Pradesh.
Existing manpower or housekeeping companies
You can apply if the name complies. Since 2022, MP does not allow FACILITY, LABOUR SUPPLIER and certain other words in an agency name. A company called "ABC Facility Services Pvt Ltd" would need a name change or a separate entity.
Young first-time entrepreneurs
There is no rule that only ex-servicemen can apply. A civilian founder who meets the requirements and completes PSARA training is eligible. Three years of ITRs are part of the list, so first-time founders without filed returns should discuss this before applying.
Women entrepreneurs
The Act does not restrict applicants by gender. A woman proprietor, partner or director follows the same requirements as anyone else.
Choosing the right entity if you are starting fresh
If you have not yet formed a business, the choice of entity is worth a little thought, because it decides whose documents and verification the application depends on.
- Solo founder, modest start: a proprietorship is the simplest. Only the proprietor's personal documents and training are needed, with Form 3 and Form 7 affidavits.
- Two or three founders who want flexibility: an LLP offers limited liability with lighter compliance than a company, but every partner needs training and verification.
- Plans to bid for corporate or government tenders: a private limited company is often preferred by larger clients, though every director must clear verification and sign affidavits.
- Existing society or trust-like body: a society can apply, with the chairman's documents and its by-laws and member list.
Whatever you choose, keep the number of owners practical. Each additional partner or director adds one more set of documents, one more training certificate and one more police verification. A smaller, fully eligible ownership group usually moves faster than a larger one with a single weak link.
A quick self-assessment
- Is your entity one of the six types listed above?
- Are all owners Indian residents with clean records?
- Has every required person completed, or booked, PSARA training?
- Do you have an office in Madhya Pradesh?
- Is your agency name unique and free of restricted words?
If you answered yes to all five, you are in a good position to apply, though the final decision always rests with the Controller after scrutiny and verification. Frequently Asked Questions
Can a one person company apply for a PSARA license in MP?
Yes. An OPC is one of the entity types that can apply. Since it is a company, its documents broadly follow the private limited pattern, including the certificate of incorporation, MOA and AOA, company PAN and the director's personal documents and PSARA training certificate, along with all standard business documents.
If one director has a criminal case pending, can the company still apply?
A pending matter is different from a conviction, but police verification will cover every director, and the outcome can affect the application. Section 6 disqualifications relate to specific grounds such as certain convictions. Take advice on the facts before filing, and consider whether that person should remain on the board.
Can an NRI be a partner in a security agency applying in MP?
The requirement is for Indian resident applicants with verified antecedents, and police verification of all partners or directors is part of the process. A non-resident partner can create practical and legal difficulties. Discuss the specific structure with us before forming the entity, so the application is not held up later.
Does the society chairman alone need PSARA training?
For a society, the listed personal documents, including the training certificate from an MP PSARA registered institute, are those of the chairman. The society also submits its PAN, by-laws and list of members along with the standard business documents such as office proof, registrations, MoU, photographs and affidavits.
